WHL Legal Pty Ltd is fully committed to the National Privacy Principles under the Privacy Act 1988 (Cth)

WHL aims to protect your privacy, and the integrity of any personal information provided to us, at least to the minimum expected by that Act.

The Kinds of Personal Information WHL Holds

Generally

WHL holds a wide variety of different types of personal information that can include names, addresses, dates of births, medical records, rehabilitation records, financial records, etc.

Our Website

If you chose to “Contact Us” or submit information while making a “Careers” enquiry then obviously we will hold the personal information you provide to us.

Otherwise, we do not collect any personal information from you by you visiting our site. We may gather general statistical information, such as:

  • The browser you used;
  • The pages, articles and links accessed;
  • When (ie. date, time) you accessed our site;
  • The domain name portion of your email addresses (e.g, the WHL Legal.com.au in smith@whllegal.com.au)).

There are no cookies on our site.

While WHL takes all possible care to protect the personal information of those visiting our site, we deny any responsibility for breaches attributable to any malicious attack (e.g. malware, etc) of our site.

Why Do We Collect Personal Information?

Generally

We collect a variety of different types of personal information (as referred to above), for a variety of different reasons. The information may come from our clients or other parties to legal proceedings (or potential parties), Doctors, Rehabilitation Providers, Investigators, Expert Witnesses, and other agencies (and of course the person themselves) so we can properly perform our role as insurance lawyers and litigators. We provide legal advice on the basis of that personal information, or use that personal information in the course of litigation.

Often, in personal injury claims, medical, rehabilitation and financial information is critical to the conduct of the claim, and that information is obtained through a variety of sources for the purpose of handling that personal injury claim on behalf of our clients.

You may have provided personal information to us for the purposes of an enquiry, or to subscribe to our mailing list (through “Contact Us”, or for a “Career Enquiry”).

Your information is then simply used for the purpose you intended.

Disclosing Personal Information to Contractors and Others

WHL only discloses personal information to contractors and others for legitimate business purposes (being insurance law and litigation). Those entities might include health professionals, investigators, experts, other parties to litigation, barristers, etc.

Generally, contractors employed (and to whom information we disclose) are contracted by us in our capacity as agents for our clients.

In some circumstances, we may be required by law to disclose personal information to others. The law permit also permits us to disclose your information for law enforcement and public safety reasons.

If I Want To See My Personal Information?

You simply have to ask.

There are legal constraints (such as legal professional privilege) on what we are able to release to you, but subject to any such constraints we would release to you the personal information we hold about you, on request. Obviously, there may be some costs involved, and there may be some delay, particularly if the request is complex, detailed or otherwise onerous.
